هي المالكة للتطبيق والعلامة التجارية ( الصناعية ) ( Senaeya )
تطبق هذه الشروط:
1-1 تنطبق شروط الاستخدام هذه على كل الخدمات المقدمة من تطبيق الصناعية وتحكم العلاقة بيننا وبين كل مستخدم لخدماتنا.
1-2 أي إشارة إلى كلمة (تطبيق) أو (تطبيق الصناعية) يقصد به تطبيق الصناعية مقدم الخدمة.
1-3 يرجى قراءة هذه الشروط جيداً قبل استخدامكم تطبيق الصناعية حيث أن استخدامكم لها يعني قبولكم لهذه الشروط وأنكم موافقون على الالتزام بها، وفي حالة عدم موافقتكم عليها يرجى عدم استخدام تطبيق الصناعية.
1-4 عند التسجيل في تطبيق الصناعية - حسب الاقتضاء - قد يُطلب منكم تسجيل الاسم ورقم الهاتف وعنوان البريد الإلكتروني.
1-5 المعلومات التي نجمعها عنكم هي المعلومات التي تعرّف عنكم كورشة أو مركز صيانة سيارات، وتشمل: اسم الورشة – السجل التجاري – الرقم الضريبي – رخصة البلدية – الموقع وساعات العمل - رقم الهاتف – البريد الإلكتروني– شعار المركز – معلومات بطاقة الائتمان ( لمقدم خدمات الدفع الإلكتروني ).
1-6 تساعدنا معلوماتكم على الاستجابة بشكل أكثر فعالية لطلبات خدمة العملاء واحتياجات الدعم الفني.
1-7 لن يتم تخزين أي من بيانات البطاقات الائتمانية وبطاقات الخصم المباشر بالإضافة إلى المعلومات التجارية أو بيعها أو مشاركتها أو تأجيرها إلى أي أطراف خارجية.
1-8 نحن لا نبيع أو نتاجر أو ننقل معلوماتكم الشخصية أو التجارية إلى أطراف خارجية، لا يشمل هذا الجهات الخارجية الموثوقة التي تساعدنا في تشغيل تطبيق الصناعية (على سبيل المثال – خدمات الدفع الإلكتروني )، أو إجراء أعمالنا، أو خدمتكم، طالما أن تلك الأطراف توافق على الحفاظ على سرية هذه المعلومات.
1-9 تطبق هذه الشروط بصرف النظر عن نوع الجهاز الذي تستخدمه للحصول على خدماتنا.
1-10 قد يتم تغيير السياسات والشروط والأحكام الخاصة بالتطبيق أو تحديثها من وقت لآخر وذلك حتّى يتم استيفاء جميع المعايير القياسية المعمول بها، بالتالي فإننّا نحثّ العميل على الرجوع إلى هذه الأقسام بشكل متكرّر وذلك لمعرفة التغييرات التي تمت.
2- استخدامكم للخدمات المقدمة من تطبيق الصناعية:
2-1 يسمح الدخول إلى الخدمات على أساس مؤقت، ونحتفظ بحق سحب أو تعديل الخدمة التي نقوم بتقديمها على الخدمات دون إشعار مسبق. ولا نتحمل مسؤولية عدم توفر الخدمات لأي سبب وفي أي وقت من الأوقات ولأي مدة.

يسمح لك بالتسجيل والدخول على التطبيق مع العلم أن بعض خدماتنا قد تكون متاحة
للمستخدمين المشتركين فقط.
2-3 حقكم في استخدام تطبيق الصناعية هو خاص لكم ولا يسمح لكم بمنح هذا الحق لأي
جهة أخرى لاستخدام حسابكم تحت اسمكم أو نيابة عنكم.
2-4 يتم تطبيق جميع الشروط والأحكام الخاصة في حالة إنشاء حساب مجاني على تطبيق
الصناعية.
2-5
أنتم تتعهدون بأن مشاركتكم في تطبيق الصناعية لا يضر بأي من حقوق للغير أو تقيد أو
حظر استخدامهم للخدمات أو انتفاعهم بها.
2-6 أنتم تتعهدون بأن استخدامكم لخدمات تطبيق الصناعية لا يتسبب بإيذاء أو إزعاج
أو مضايقة الآخرين سواء بشكل شخصي أو في المشاركات العامة.
2-7 تتعهدون بعدم وضع صورة شعار على حسابكم الخاص على تطبيق الصناعية تنتهك الآداب
العامة.
2-8 تتعهدون بعدم القيام بأي أعمال تنتقص أو تحط من قدرنا أو قدر الآخرين أو من
منتجاتنا أو خدماتنا.
2-9
أنتم المسؤولون عن سرية التفاصيل الخاصة بحسابكم على تطبيق الصناعية وكذلك عن أي
أنشطة تحدث في الحساب الخاص بكم، وإذا كان لديكم مخاوف من أن الحساب الخاص بكم يتم
استخدامه من خلال شخص آخر، يجب عليكم التواصل معنا من خلال الدعم الفني.
2-10 نقوم بمحض اختيارنا بتحديد وجود أي خرق عند استخدامكم للخدمات، وعند حدوث أي
خرق، نقوم باتخاذ الإجراءات التي نراها مناسبة، بما فيها:
أ- الإيقاف الفوري المؤقت أو الدائم لحقكم في استخدام خدماتنا.
ب- توجيه تنبيه إليكم.
ج- اتخاذ الإجراءات القانونية بحقكم لتعويضنا عن كافة التكاليف على أساس التعويض
بسبب الخرق.
د- الإفصاح عن تلك المعلومات الضرورية إلى سلطات تنفيذ القوانين وفق ما نراه ضروري.
هـ - بإمكاننا اتخاذ أي إجراءات أخرى نراها مناسبةً بصورة معقولة.
3- الشروط الخاصة بالمحتوى المقدم من تطبيق الصناعية:
3-1
يحتفظ تطبيق الصناعية بكافة حقوق النشر للمحتوى المعروض من أعمال الورشة
وتصنيفاتها وترميزها ومعلومات السيارات وتفاصيلها وقطع الغيار وأرقامها وغيرها،
حيث تكون ملكية لنا ومرخصة لنا كما يكون هذا المحتوى محمياً بقوانين واتفاقيات
الطبع والنشر، كما تكون كافة هذه الحقوق محفوظة لنا، لا يجوز تداولها ولا يمكن
استخدام أي محتوى بغرض تجاري، وأنتم توافقون على عدم نشر أو بث أي من المحتويات
المذكورة أعلاه دون الحصول على موافقة خطية من تطبيق الصناعية.
3-2 جميع أعمال الورشة وتصنيفاتها وترميزها ومعلومات السيارات وتفاصيلها وقطع
الغيار وأرقامها، تخضع للمراجعة والتعديل بدون إشعار مسبق، فضلاً عن إمكانية
اتخاذ إجراءات قانونية في حالة حدوث أي إساءة استخدام المحتوى، ويمتلك تطبيق
الصناعية جميع الإضافات التي سيقوم بها ويعتبر ملك لتطبيق الصناعية وحده وله حق
التصرف فيه.
4- الاشتراكات والرسوم:
4-1
تعرض بعض الخدمات المدفوعة مقابل رسم اشتراك في الخدمة.
4-2 عند استخدام الخدمة من جهاز محمول قد تكون هناك بعض الرسوم الإضافية لاستخدام
شبكة الإنترنت وذلك وفقًا لشروط التعاقد مع مشغل خدمات الاتصالات.
4-3 قبل استخدام الخدمات المدفوعة يوصى بأن يستعلم المستخدم عن أي رسوم سيتم خصمها
من بطاقة الائتمان، ويتحمل المستخدم المسؤولية الكاملة عن التأكد من صحة المعلومات
التي سيتم إدخالها في الخانات ذات الصلة.
4-4 يوصى بالحصول على والاحتفاظ بنسخة من إيصال إتمام العملية لأغراض حفظ البيانات
والتي قد تساعد في فض أي نزاعات قد تنشأ عن استخدام الخدمات المدفوعة.
4-5 قد نقدم من وقت لآخر عروضًا تجريبية للخدمات المدفوعة لمدة محددة مجانًا.
نحتفظ بحقنا، كما ويحق لنا سحب أو تعديل العروض التجريبية في أي وقت دون وقوع أي
مسؤولية علينا.
4-6 على المستخدم أن يفهم أن استعادة مبلغ الاشتراك غير متاح، ويحق له التواصل مع
خدمة العملاء لطلب استرداد المبلغ ويتم دراسة الطلب من إدارة تطبيق الصناعية.
4-7 على المستخدم أن يفهم أن استعادة رسوم خدمة الدفع الإلكتروني غير متاح، وسيقوم تطبيق الصناعية بإعادة قيمة الرسوم في حال قررنا أن المستخدم قد تعرض لعملية غير صالحة، وسنحدد مقدار القيمة وفقًا لتقديراتنا.
5- إنهاء الخدمة:
تطبيق الصناعية يحتفظ بحق تعليق أو إنهاء اشتراككم في الخدمات المقدمة دون سابق إنذار في حالة اختراق أي من شروط وأحكام الاستخدام.
6- الحد من المسؤولية / مسؤولياتنا تجاهكم:
6-1 لا
يمكننا أن نتعهد بأن استخدامكم تطبيق الصناعية سيكون خالياً من الأخطاء التقنية أو
أخطاء في المحتوى، نحن مستمرون في تحديث وتطوير خدماتنا ومعالجة أي أخطاء في
التطبيق.
6-2 لا تقع علينا أي مسؤولية أو التزام قد ينشأ من اعتمادكم على الخدمات أو على
المحتوى أو أي شخص تم تبليغه بهذا المحتوى.
6-3 مسؤولية التحقق من دقة وصحة المعلومات المقدمة في فاتورة العميل تقع على صاحب الورشة أو مركز الصيانة.
6-4 على صاحب أو مدير الورشة أو مركز الصيانة الحفاظ على سرية معلومات العملاء وعدم إفشائها أو بيعها أو المتاجرة بها لأي أطراف خارجية، ويكون لدى إدارة تطبيق الصناعية التصرف تجاه أي جهة بما تراه مناسب وفق الأنظمة والقوانين.
7- التعويض:
7-1
أنتم توافقون على تعويضنا عن ومقابل أيّ من وكافة المطالبات أو الإجراءات أو
الدعاوى أو المرافعات، وكذلك أيّ من وكافة الخسائر والالتزامات والأضرار والتكاليف
والنفقات (بما فيها الرسوم القانونية المعقولة) والتي تنشأ عن:
7-1-1 أي تضليل أو تصرف أو إغفال من قبلكم فيما يتعلق باستخدامكم للخدمات.
7-1-2 عدم التزامكم بأيّ من هذه الأحكام والشروط.
8- سلطة الاختصاص القضائي والقانون النافذ:
8-1
تكون لمحاكم المملكة العربية السعودية سلطة الاختصاص القضائي الحصري على أي مطالبة
تنشأ عن أو تتعلق بالخدمات المقدمة لكم.
8-2 تخضع هذه الشروط وأي نزاع أو مطالبة تنشأ عن أو تتعلق بها أو بموضوعها أو
صياغتها (بما في ذلك النزاعات أو المطالبات غير التعاقدية) وفقًا لقوانين المملكة
العربية السعودية.
9- حررت هذه الشروط والأحكام باللغة العربية واللغة الإنجليزية، وعند اختلاف المعنى أو فهم المقصود، تعتمد نسخة اللغة العربية هي المرجع الأساسي في فهم الشروط والأحكام.

It owns the application and trademark (Senaeya – الصناعية)
These terms apply:
1-1 These Terms of Use apply to all services provided by the Senaeya Application and govern the relationship between us and each user of our services.
1-2 Any reference to the word "Application" or "Senaeya Application" refers to the Senaeya Application, the service provider.
1-3 Please read these terms carefully before using the Senaeya Application. Your use of them signifies your acceptance of these terms and your agreement to abide by them. If you do not agree to them, please do not use the Senaeya Application.
1-4 When registering for the Senaeya Application, as appropriate, you may be asked to provide your name, telephone number, and email address.
1-5 The information we collect about you is information that identifies you as a workshop or car maintenance center, including: workshop name, commercial registration, tax number, municipal license, location and hours of operation, telephone number, email address, center logo, and credit card information (for electronic payment service providers).
1-6 Your information helps us respond more effectively to customer service requests and technical support needs.
1-7 None of your credit card and debit card information, as well as your business information, will be stored, sold, shared, or rented to any third parties.
1-8 We do not sell, trade, or transfer your personal or business information to third parties. This does not include trusted third parties who assist us in operating the Senaeya Application (for example, electronic payment services), conducting our business, or serving you, as long as those parties agree to maintain the confidentiality of this information.
1-9 These terms apply regardless of the type of device you use to access our services.
1-10 The policies, terms, and conditions of the Application may be changed or updated from time to time to meet all applicable standards. Therefore, we encourage you to refer to these sections frequently to learn about any changes.
2- Your Use of the Services Provided by the Senaeya Application:
2-1 Access to the Services is permitted on a temporary basis. We reserve the right to withdraw or modify the services we provide on the Services without prior notice. We are not responsible for the unavailability of the Services for any reason, at any time, or for any period.
2-2 You are permitted to register and log in to the Application, noting that some of our Services may be available to subscribed users only.
2-3 Your right to use the Senaeya Application is exclusive to you, and you may not grant this right to any other party to use your account under your name or on your behalf.
2-4 All special terms and conditions apply if you create a free account on the Senaeya Application.
2-5 You warrant that your participation in the Senaeya Application will not infringe upon any third party's rights or restrict or prohibit their use or enjoyment of the Services.
2-6 You warrant that your use of the Senaeya Application Services will not cause harm, inconvenience, or harassment to others, whether personally or in public posts.
2-7 You agree not to place a logo on your account on the Senaeya App that violates public morals.
2-8 You agree not to engage in any actions that disparage or degrade us, others, or our products or services.
2-9 You are responsible for the confidentiality of your account details on the Senaeya App and for any activities that occur under your account. If you have concerns that your account is being used by someone else, you should contact us through technical support.
2-10 We will, at our sole discretion, determine if there has been a breach of your use of the Services. In the event of a breach, we will take any action we deem appropriate, including:
a. Immediate, temporary or permanent suspension of your right to use our Services.
b. Issuing a warning to you.
c. Taking legal action against you to reimburse us for all costs on an indemnity basis due to the breach.
d. Disclosing such necessary information to law enforcement authorities as we deem necessary.
e. We may take any other action we reasonably deem appropriate.
3- Terms for Content Provided by the Senaeya App:
3-1 The Senaeya App reserves all copyrights to the displayed content, including workshop work, classifications, coding, vehicle information, details, spare parts, numbers, and other content. This content is owned and licensed to us, and is protected by copyright laws and agreements. All rights reserved. It may not be traded, and no content may be used for commercial purposes. You agree not to publish or broadcast any of the above content without obtaining written consent from the Senaeya App.
3-2 All workshop work, classifications, coding, vehicle information, details, spare parts, and numbers are subject to review and modification without prior notice. Legal action may be taken in the event of any misuse of the content. The Senaeya App owns all additions it makes, and they are the sole property of the Senaeya App, which has the right to dispose of them.
4- Subscriptions and Fees:
4-1 Some paid services are offered for a subscription fee.
4-2 When using the service from a mobile device, there may be additional internet charges, depending on the terms of the contract with the telecommunications service provider.
4-3 Before using paid services, it is recommended that the user inquire about any fees that will be debited from their credit card. The user bears full responsibility for ensuring the accuracy of the information entered in the relevant fields.
4-4 It is recommended that the user obtain and retain a copy of the transaction receipt for data preservation purposes, which may assist in resolving any disputes that may arise from the use of paid services.
4-5 From time to time, we may offer free trial offers for paid services for a limited period. We reserve the right to withdraw or modify trial offers at any time without incurring any liability.
4-6 The user understands that refunds are not available. The user has the right to contact customer service to request a refund, and the request will be reviewed by the Senaeya Application Management.
4-7 The user must understand that refunding the electronic payment service fees is not available, and the Senaeya Application will refund the value of the fees if we determine that the user has been subjected to an invalid transaction, and we will determine the value amount according to our discretion.
5- Termination of Service:
The Senaeya Application reserves the right to suspend or terminate your subscription to the services provided without prior notice in the event of a breach of any of the Terms and Conditions of Use.
6- Limitation of Liability/Our Responsibilities Towards You:
6-1 We cannot guarantee that your use of the Senaeya Application will be free of technical errors or content errors. We are continuing to update and develop our services and address any errors in the application.
6-2 We are not responsible or liable for any reliance you may have on the services, the content, or any person notified of such content.
6-3 The responsibility for verifying the accuracy and validity of the information provided in the customer invoice lies with the workshop owner or maintenance center.
6-4 The workshop owner or manager must maintain the confidentiality of customer information and not disclose, sell, or trade it to any third party. The Senaeya Application management may act towards any party as it deems appropriate in accordance with the laws and regulations.
7- Indemnification:
7-1 You agree to indemnify us from and against any and all claims, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:
7-1-1 Any misrepresentation, act, or omission by you in connection with your use of the Services.
7-1-2 Your failure to comply with any of these Terms and Conditions.
8- Jurisdiction and Applicable Law:
8-1 The courts of the Kingdom of Saudi Arabia shall have exclusive jurisdiction over any claim arising out of or related to the Services provided to you.
8-2 These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by the laws of the Kingdom of Saudi Arabia.
9- These Terms and Conditions have been drawn up in Arabic and English. In the event of a difference in meaning or interpretation, the Arabic version shall prevail.
